Hearing set in area murder case
A preliminary hearing now is set for May for a former Olathe man accused in the 2004 kidnapping and drowning death of his estranged wife.
A hearing will be conducted at 10 a.m. May 12 in Leavenworth County District Court to determine if enough evidence exists to try Gary Hicks on charges of kidnapping and first-degree murder in the death of Patricia Kruse Hicks, according to Deborah Owens of the Leavenworth County Attorney's Office.
Gary Hicks is accused of kidnapping Mrs. Hicks from her home. Her body was discovered April 21 in a pond west of Lansing, three days after she was last seen alive at her Olathe home. Police had found signs of forced entry into the home of Mrs. Hicks, who had filed for divorce from her husband last March.
According to Owens, Hicks' attorney has withdrawn his motion for the independent mental evaluation, and so Hicks was found competent to stand trial, based on a state mental evaluation.
