Are you truly this stupid???????? Your actions as a committee and as so called individual representatives of us the citizens of Basehor are totally out of line. WE CITIZENS NEED TO BRING BACK LOUGHRY and FIRE YOUR STUPID, INCONSIDERATE,CHILDISH, MORONIC,IRRESPONSIBLE, FOURTH POINT OF CONTACT, WEAPONS GRADE STUPID,BACK-SIDES out of office and put people like Mr. Loughry and other indivduals who truely care about our community and the citizens of Basehor and want to take this city into the 21 CENTURY back in office, NOT BACKWARDS. I WILL BE AT EVERY SINGLE GD MEETING TO ENSURE YOU KNOW WHO I AM. A VET THAT FOUGHT FOR 21 Years in uniform andI have the record to prove it. ...... And yes I have read your so called packet.... and it DOES NOT CHANGE MY OPINION AND YES YOU THREE ARE MENTALLY CHALLENGED!!!!!!!!
As I continue to try and sort out this mess....................................there must be a way to remove these three council members from office so they cannot do any additional harm to the city. Perhaps a recall or referendum of those three would be in order. I wonder who they will go after next? Someone needs to check with the county attorney to see what options are available.
I need to clarify a few items here.
1) The packet from the previous City Attorney was not an open record until after the meeting. I would have to believe that pressure by either the public or the news agencies caused the City Attorney to release these documents three days later.
2) Discussion about personnel matters were discussed at previous work session and many emails to the attorney in which she emailed the entire Council. In the executive session on 9/12 I felt like there would be support on the removal due to discussions about addendum.
3) I sent an email on July 28th asking the Mayor to provide the review forms to carry out a formal review with no response. "Where are the review forms that the "Mayor" is to get to the council for his "yearly" review?". On August 1st we tried to have a review but no forms from Mayor. The contract states how reviews are to be carried out. You would need to ask the Mayor why this did not happen.
Bottom line is there will be a few to try and play this out in the media and try to get sympathy but I can say that I am doing what my "Governing Body Handbook" states I must do when I see potential wrongdoing. I can't control how others act or what they say.

I have nothing to hide. I took an oath and plan to fulfill those commitments.
Also, I told the press yesterday that I would stop giving interviews as this is over and done. We need to move on.
One word stands out to me - "potential". Shouldn't there be actual wrong doing before we fire someone without them being present or given a chance to defend themself?
Dennis can you please tell the community members why you decided not to give Mr. Loughry a public hearing to defend himself. Firing someone while they are on vacation seems a little bit shady to me. Why don't you tell everyone the real reason that you fired the city administrator instead of hiding behind a let from the EX city attorney that is over a year old.
Also, Dennis I don't know if you have realized this or not, but the community does not support your actions so I don't think anyone is going to just get over it and move on as you like to say.
Big surprise here.....Dennis coming out to defend himself and his actions. I hope you really don't expect us to believe that your motion came about without previous discussion with Dysart and Box! Box admitted as much in the newspaper but only after he said he couldn't comment!

And seriously Dennis, WTH does #3 have to do with anything that is being currently discussed? It is obvious you are on a power trip and unfortunately you're not nearly as smart as you think you are.

That is an unscientific pole, as anyone can vote a dozen times. By the way, I hope the Mr. Mertz and the city taxpayers are ready to shell out some serious dollars if there is a law suit filed by Mr. Lowry because of the damage you have done to his reputation without cause or giving him a chance to defend himself.
I can't say that agree or disagree with the actions taken by our council (which from what I see is now 3 people on a power trip) due to the fact that I do not know Loughry at all, and im sure there is a reason for the action . However I am shocked that these people especially Mertz still have a chair anywhere near city hall. Cleary they spoke about this matter outside of council meeting(illegal). Clearly they did not give Loughry 10 days notice(contract breech). Most shocking of all they reappointed this man 4 months ago while he was sitting in front of them, then the first chance they get while he is out of town... FIRED.(cowardly)
Nothing illegal occured here on Councils part. That is fact. Please don't slander if you were not there. If you really want the truth email me and I can show emails of my dis-satisfaction being email by city attorney to everyone.
I apologize to council and Mr. Mertz if my comment was slanderous. Not even disagreeing with the firing. However I am concerned that a suite or severance package loughry may be awarded is going to cost the city.Any chance of this happening? I hope the firing will eventually be justified but think it could have been handled much better.
Dennis didn't the city administrator contract have a provision in it to how his termination process would go. Something like 10 days written notice and a public hearing. Did you follow these guidelines? If not what does that mean for the Basehor Community?

Mertz was shady and manipulative before he took an unopposed seat and further proves it. Now he and his cohorts are going to cost the City of Basehor much money to defend this lawsuit or pay a settlement. Way to go! Small town minds, small town good 'ol boy actions. Where is the recall petition?
The Loughry problem won't be the only issue costing the citizens of Basehor. Them 3 also voted on Lot A for the new city hall location instead of Lot C or Lot D. Lot A has 3 houses, 3 septics, water well and Milk facility that needs to be tore down and/or decommissioned. That alone will cost a bundle. If the houses have asbestos and the property has environmental issues that will be costly. Lot C and D are empty plus 5 acre lots vs 3.5 for Lot A. Another issue voted on without a discussion or contingency about environmental issues.
Hope everyone gets big raises this year to pay for your taxes.
GoBobcats, So if the top employee is stealing money from the coffers, are you suppost to keep him? Are you ok with this? From the printouts I reviewed from the previous attorney the language sounds pretty straight forward. It was an illegal move between the mayor and city administrator.
The nerve of him trying to come forward with a change to add these to his pay after he stole the benefits. Am I correct that it was over $1,000 a month [from another article]? He was there over 2 years? You do the math... Shame on you.
What about the fact that the 2ND page says he lied about his pay at his last job? You should really read this before making anymore comments. If we were to match the pay [from another article] and he made $76,000 then why did the council pay him $88,000. Why did mark say he made $85,000 when it was really $9,000 less?
Question, why did entire council and mayor for let this go on so long?
Dennis, Ires and Box should be thanked for calling an end to theft. I would have your Chief of Police investigate this for possible theft and get our money back.
Taxpayer2, What is this land A, C, D? Where are these properties?
If there was a theft then by all means, prosecute away! However, the manner in which this was handled shows the immaturity and backroom small-town politics that are currently in place with the Basehor City Council. If there were improper acts occurring, follow the proper channels, address it per the contract, inform the public and handle it appropriately. Do not violate the open meetings act. If this was done with the best interest of the town in mind, then do it correctly, with integrity, not with the good 'ol boy system and save the City the costs associated with defending a lawsuit.
gobobcats - There was no violation of KOMA (Kansas Open Meeting act). There was some talk about dis-pleasure in an executive session on September 12th. There are more items in which I based my decision. I can not go into detail. No matter what the contract states, the Kansas Statutes will prevail in this matter.
bestforbasehor - There was discussion about the land on June 6th item 5 at the work session. Again it was discussed September 12th item 3..Then it came up for a vote on September 19th item 7. Citizens expressed their support in favor of area "A". Someone is just trying to muddy the water here. The land was FREE!!!...This property is on 155th Street across from the current city hall and fire department. It is 5 times bigger than we have now. I think it is the perfect choice for a future City hall.
If there was no discussion outside of executive session or regular meetings, then why were two council members unaware of the matter and why was it done when the City Administrator was unable to attend? I think if you had information to support your allegations, presented it in a proper manner with good communication you would have had overwhelming public support. Instead it appears the three of you conspired behind the scenes to oust this guy for whatever personal agenda you all have.
bestforbasehor: Do you realize that you are calling the ex city manager a thief? That is slander. He has not been convicted of any crime or for that matter even charged in a court of law. Also you bash everyone for creating anonymous comments, however your own comment is listed as anonymous. You say that you have lived in Basehor for many years. Your knowledge and wise years do not show in your postings.
The other properties suggested for a city hall site were also free. And they are more than enough property for the city hall.
I've lived in Basehor for 5 years. My family chose to call Basehor home for one reason: Our children. We know our neighbors well, attend city functions, support local clubs and organizations, and have attended both coucil meetings and worksessions... All in the hopes of becoming a funcitonal part of this community.
I'm sure in due time, more information will be provided to residents relating to the specifics of this issue allowing us to make an educated decision on actions of the council. We may even have to seek out some of that information on our own.
Basehor citizens continually bash each other, our elected officials, our local leaders, organizations, etc. Please... continue to jump to conclusions, form your opinions from one source of information, fly off the handle, storm off like children, point fingers and gossip amongst yourselves. Lead our children by example and portray our community for the "outside" world in the light it deserves. BEFORE judging the actions of the Council and City administration, we should all take a long hard look at ourselves.
If you don't like the way things are run, get up, get active, get involved. everday, not just when news hits the paper.
Bottom line is because the three didn't follow the contract he had signed they just cost us all a lot of money. I'm sure Mr. Loughry is going to sue the city and the three idiots , and rightfully so. If they would of followed the rules and not had gotten into a hurry this wouldn't of happened. Mertz says he was doing whats right for the citizens of Basehor. Don't do us any more favors. To fire a man while he is on vacation so you don't have to face him shows how big of a chicken ---- you three are.
Corruption is insidious, a viral infection that turns cancerous if ignored over time -- and that's what has happened to the city of Basehor. Like corruption, investigations have a way of going viral. It's the only way it can be stopped.I have lived in the Basehor area for many years and I am not surprised to hear about the corruption. Just recently I read about the city giving the employee’s 14% retirement benefits. Wyandotte County only gets 7% and we also have to contribute. Why was Basehor the only City in the State to get double the retirement? Well I read that this was changed last month. For years developers, builders and just plain people with greed in mind have run the city. Finally we have a council who are correcting the wrongs. I am also not surprised that employees and people who don’t want this to stop have created anonymous user names here and are defending the corruption. I guess you don’t want people ruining a good thing like taking money from the citizens. Why are you trying to get our attention to move to the “10 day” contract restriction or the fact he was on vacation? Like a shell game, you are trying to get people to forget about the fact that the Mayor and Administrator violated and ignored the rules/law…. Who cares if corruption is uprooted during a vacation. Quit crying. I’m happy that it is over.
Would you move your family to a new city, leaving a secure job, in order to receive less pay and benefits than you were receiving on your old job? I think not! Mr. Lowry was due a raise in Hays to bring his pay up to the figures he gave. He got regular increases with the rest of the city employees in Hays. What is so irregular about your job providing health insurance for you and your family, especially when you are the city manager? Bottom line, this decision by our city fathers has the potential of costing the taxpayers a bunch of money. You have, in this citizen's opinion, ruined Mr. Lowry's reputation.

I just heard that Councilman Dennis Mertz has an inside track, he resides with the city prosecutor. Conflict of interest?
As I read through the comments here, I'm stuck by the nasty tone of those defending the administtrator and mayor. Most of those in support of the removal seem to defend the action by a simple statement of fact. Whether or not I agree with the action taken and the way in which it was taken, I commend Mr. Mertz for answering the anonymous attacks with a calm reasonable reply - without concealing his identity.
Neither side in this discussion is basing things purely on 'statements of fact'. Leave it to the State and County Attorneys to get the statements of fact. Go back and do the review and firing AS THE CONTRACT SAID IT SHOULD BE DONE.
Let's get on with the REAL BUSINESS OF THE CITY.
MY question is..... All of you that are disrespecting "the three counsel" members.....and saying what a horrible job they have/are doing.... IS THE CITY OF BASEHOR GOING TO SEE YOUR NAMES ON BALLETS NEXT ELECTION? I dont live in Basehor but do work there, and I am a little informed on what is going on, but i see a lot of angry people and I just wonder how many of you will put your money where your mouth is? Just saying..........

Allow me to repost my original comment:
The main topic is how the City Council and Mayor handled the City Mananger.
The topic is not about "growth" or "dark ages."
The community IMO does not have enough information to come to a conclussion--many posts are anonymous and there appears to be a lot of knee jerk reaction for and against the council members vote. I don't have enough information to voice an opinion, nor have I spoken with Mr Loughry, members of city council, or the Mayor Hill.
Please keep in mind the people voted for who best can mirror their voice for city council. This City Manager vote was split and now has clearly put a division within the community.
For now, there seems to be three losers: the Loughry family, the City of Basehor, the taxpayers of Basehor.
My opinion: The City of Basehor needs a City Manager. Since the community is evenly split on this decision (according to the non scientific online poll) a solution is needed. Keep in mind we still need a City Manager and I think the best qualified person for that job is Mr. Loughry. I say his salary starts at 80k with his insurance is paid 100% with his family plan at 80% paid by the city. If he agrees to this, a recall vote is initiated against Dennis Mertz--that is only if Mark Loughry accepts the City of Basehor's offer.
I have yet to talk with any of the folks involved and haven't seen any solutions offered other than conjecture, finger pointing, and cheerleading on these forums. I truly hope that the next meeting doesn't turn into a BM session and the community can work through this with solutions. We need a City Manager.
