Judge denies Basehor mayor's request to put recall election on hold

Mr, can you tell me why this would go before election and not before jail¿ I dont understand this criminal sistem¿

Former Basehor administrator Loughry suing city for more than $500,000

I thought I had a handle on this until I read the briefs and memorandum's from the Judge. So now am I to side with Hill and Loughry because they altered a contract and clearly this is the precise reason the legislation was passed to stop this? Can someone answer this. I also am concerned with the misdirection of the money but I feel the important item here is the other items claimed.

21-5920. Tampering with a public record.
(a) Tampering with a public record is knowingly and without lawful authority altering, destroying, defacing, removing or concealing any public record.
(b) Tampering with a public record is a class A nonperson misdemeanor.

I do believe the Judge ruled that the Mayor / Administrator altered the contract if I am correct? Was this addressed at today's hearing?
